  4. Intellectual Property: Unless specified in a client contract, all intellectual property rights for the work created by In the Clouds Design Co. belong to Rachel Loewen. Clients are granted a non-exclusive, non-transferable license to use the delivered products solely for their intended purposes.
  5. Limitation of Liability: In the Clouds Design Co. disclaims any liability for damages or losses incurred by clients or third parties arising from the use of our services. We shall not be held responsible for any indirect, consequential, or incidental damages.
  6. Payment Terms: For Intensives or consultation calls, payment is due at the time of booking. For website and brand packages, a 50% deposit is required upon acceptance of the project proposal, with the remaining 50% due upon final project delivery. In the case of a payment plan, the first payment serves as the deposit. Failure to provide necessary assets or communication delays by the client may result in a 5% per day fee.
  7. Deposit and Cancellation: Clients understand that a deposit is required to secure a project's initiation. In the event of client cancellation after payment, the deposit is non-refundable. In the Clouds Design Co. reserves the right to cancel or terminate a contract at any time and at our discretion.
  8. Dispute Resolution: Any disputes arising from the use of In the Clouds Design Co's services shall be resolved through negotiations and discussions in good faith. If a resolution cannot be reached, the parties agree to submit to the exclusive jurisdiction of the courts in Washington for legal proceedings.
  9. Amendments: In the Clouds Design Co. reserves the right to modify or update these Terms & Conditions at any time without prior notice. Changes will become effective upon posting the updated version on our website.
